International justice begins at home.
The ICC is a court of last resort, acting only when governments are genuinely unable or unwilling.
All ICC member states are obliged to prosecute perpetrators of grave crimes first. But to do that they must adopt national laws in line with the Rome Statute.
However, the drafters of the Rome Statute gave the UN Security Council the power to refer situations, including in states that have not accep ted its jurisdiction, to the ICC prosecutor for potential investigation when it believes there is a threat to international peace and security.
We monitor the ratification of this amendment and urge all states to consider it in a constructive and cooperative manner.

However, the Court cannot exercise jurisdiction over the crime until the amendment is ratified by at least 30 states and the ICC’s governing body decide s to activate it. This cannot happen before 2017.
